It all depends on the meaning of "state", "deprive", "person", "life", "liberty", "property", "due process" "law", "jurisdiction", and "equal protection", which should be based on the whimsical decision of a liberal judge filtered through her idiosyncratic experience as a wise Latina and her opinion on the laws of other countries!

Basically they wrote the constitution as a workaround to achieve as much sweaty, crushed-velvet-and-lacy-sleeved man-on-man power ass-sex as possible. The rest is detail.
