Yes but the question before the courts is not whether the picture is degrading it is whether or not it is newsworthy? The is issue is not right to privacy because the rape occurred in a public place with now expectation of privacy. The issue is right to publicity. The point of contention here seems to be that if you can reasonably argue that the publishing of a picture had news value than the right to publicity is also trumped. It's hard to argue this wouldn't have news value. God knows what the court would rule. My point is that is not so cut and dry.
I won't argue that it is morally and ethically wrong to publish the pictures. I am arguing that it is not legally wrong.

I still think it is also legally wrong but not without seriously using legal action. Either way we would probably need an legal expert who specializes into copyright issues and the like. In college i had a seminar where it was discussed briefly but that is no expertise on my part i could really bring forward.
