He's pretty with it, all things considered.

He apologized to me.

They arraigned him in the hospital last week sometime, he pled guilty to all charges.

They're tranfering him to the hospital in adjoining couty (larger hospital with a detention ward) come Monday.
He's not going to cooperate with the D.A. in prosecuting me, he's asked them to drop charges against me.
They of course told him that it's not his decision to make and they have a strong enough case agaist me that they don't really need him.

My public pretender said yesterday that it's all about perception and he's sure we can win the case.
He's examined my psych records and firmly believes, given my diagnosis and the video evidence, that the prosecution will make our case for us.

I personally feel, after visiting Billy Bob in the hospital, that I should change my plea to no contest and cry mercy. I feel just horrible about what happened.

You both sound like fundamentally decent folk, to be honest, albeit in a kind of fucked up way what with the hair triggers and explosive violence.

I am to turn myself in tomorrow to face arraignment on a new charge, Aggravated Assault! I'll be re-released right after O.R.
Billy Bob (um not his his real name, but frightenly close) not only lost the vision in his left eye, he lost the eye, and there was evidently some brain damage, but they haven't determined how much since it turns out he'd been kicked in the head by a horse a few years ago.

I saw the videos, motherfucking brutal!

For awile we were pretty much even, but when he slipped in some blood I grabbed him by the neck!

I really, really hurt this guy. I beat his head against the corner of a shelf repeatedly.

My arm and fingers got broken when the guys tackled me.


If not for the fact that he did throw the first punch, I'd probably be looking at an attempted murder charge right now.


The deal is this;

I cop a guilty plea to Aggravated assault with special circumstances (2 to 5 years), the prosecuter will recommend minimum sentence (but there is no promise the judge will accept the recommendation), plus parole equalling the difference between my time served and 5 years.

I'll serve my time in administrative segregation at a medium security prison.

In exchange for my plea, the prosecuter has agreed not to seek new charges against me if this fella should die (I assume this is a remote possibilty), he'll also push for minimum sentence and the case against my wife will be dimissed.

My lawyer thinks we can beat the charges at trial, but the decision is mine to make. I have until 9am tomorrow to decide.

According to the lawyer, Mama Buggy could do 90 days with 18 monthes probation, but he thinks she'd likely avoid jail time alltogether.

Thelma Lou got her parole revoked for cause, she'll be finishing out her original 3 year sentence (14 months) plus she faces new chages; 2 counts simple assault.


I don't know what to do, if I take the deal, I'll probably serve the min., in protective custody, Mama Buggy would be spared altogether. If I go to trial and lose, I could do the max in general population at a maximum security prison and the wife would also stand trial. If the guy should die, I could face new charges.

Lawyer says he can't a lesser charge, but might be able to get me incarcerated in a mental hospital.


I wonder if I could serve my time in isolation?

Best case, I go away for at least 3 months, maybe more, I get released to parole. And on top of everything else I lose my disability.

Maybe they help, maybe they don't.

But at the end of it I'm a covicted felon with a psych jacket, I'll have trouble even obtaining housing, let alone anything else.

Worst case;
everything Ilisted above, plus My mental health erodes further and faster, all the while getting ass raped by a lunatic convinced that I've got a hidden microphone put up my anus by space aliens working with the New York Knicks to take his last everlasting Gobstopper. His goal in violently and repeatedly ravaging my delicate nether regions is to disable the mic by beating on it with his dick.

Don't take the deal. If they're giving you deal upon deal the ball is in your court. That means they can't prove shit at trial. Wait it out, you may get a sweeter deal with just house arrest and probation. If not, just go to trial, you will probably walk out a free man.
